1. What you are buying

This product is a digital download consisting of Logic Pro project template files and associated included content as described on the product page.

Your purchase gives you a limited, non-exclusive, non-transferable licence to use the product in accordance with these terms. It does not transfer ownership of any intellectual property rights in the product to you.

2. Intellectual property ownership

All intellectual property rights in the template pack, including without limitation the project structure, arrangement, audio demonstrations created for the pack, text, branding, graphics, downloadable materials and any original included content owned by us, remain the property of Dave Parkinson Studio and/or its licensors.

All rights not expressly granted are reserved.

3. Permitted use

Subject to these terms, you may:

download and use the template pack for your own personal studio use

study, analyse and modify the templates for learning and music production purposes

use the templates as a starting point, reference or creative tool in the creation of your own original music

render, release and commercially exploit new original musical works you create using the template pack, provided those works are sufficiently transformed into your own production and do not amount to a resale, reproduction or near-copy of the template itself

4. Prohibited use

You may not:

share, transfer, sublicense, rent, lend, gift or distribute the template pack or any part of it to any other person

upload the files to file-sharing platforms, forums, cloud folders, torrent sites, sample sites or public/private download groups

resell, repackage, relabel or redistribute the template pack or any part of it, whether modified or unmodified

include the files in any other sample pack, template pack, preset pack, educational product or commercial bundle

5. Release restrictions

This product is sold as a learning and production tool.

You may use it to help create your own tracks, but you may not simply release, distribute or commercially exploit the template pack “as is” or in a form that is substantially similar to the original supplied files.

Any commercial release created with the help of this pack must be your own original work and must contain meaningful creative changes and independent production input by you.

6. Third-party software and plugin requirements

This product is designed for use with Apple Logic Pro v 11.1.2 or higher and may require certain third-party plugins for full functionality.

At the time of sale, the following third-party plugins are required for full playback and/or access to certain sounds, presets or processing chains:

file standards or operating environments

Software platforms and plugins can change, become unsupported or obsolete over time. We are not responsible for incompatibility arising from future software, OS or plugin changes outside our control.

8. Third-party content

Where this product references or is designed to work with third-party software, trademarks or plugins, those remain the property of their respective owners.

Your use of any third-party software, samples, presets or content is subject to the terms imposed by the relevant third-party rights holder.

9. No guarantee of artistic or commercial outcome

We do not guarantee that use of this product will result in:

label signings

streaming success

chart placements

sync placements

improved production results

compatibility with your specific workflow or studio setup

Results depend on the user’s own skills, software environment and creative decisions.

10. Digital downloads, cancellations and refunds

This product is supplied as digital content.

By completing your purchase and starting the download or accessing the files, you expressly agree that delivery begins immediately and acknowledge that your standard cancellation right may be lost once download/access has begun.

Nothing in these terms affects your statutory rights. If the digital content is faulty, not as described or we did not have the right to supply it, your legal rights under applicable consumer law remain unaffected.

11. Support

Unless expressly stated otherwise, purchase of the product does not include ongoing technical support, software updates, plugin updates, compatibility maintenance or future revisions.

Any support offered is provided on a reasonable endeavours basis only.

12. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental or consequential loss, including loss of profits, loss of opportunity, loss of data, business interruption or studio downtime arising from use of, or inability to use, the product.

Nothing in these terms limits liability where it cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence.

13. Breach

If you breach these terms, your licence to use the product terminates immediately and automatically. We reserve the right to take action to protect our intellectual property and enforce these terms.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales shall have jurisdiction, unless mandatory consumer law in your country of residence provides otherwise.
